Terms of use

For the free trial of Hermanas Tools at tools.hermanaseng.com. Last updated [date]. By signing in you accept these terms on behalf of yourself and, if you are using a work account, your organisation.

The short version: it's free, it's provided as is, the results are an aid and not a substitute for your own schedule and your own judgement, you must have the right to upload what you upload, trial workspaces are deleted after 30 days of no sign-in, and we can change or end the free service. Licensed use is under a separate agreement.

1. What the service is

Hermanas Tools is a set of browser-based planning tools — currently Schedule Lens, Approvals Horizon and the Integrated Reporting Dashboard — provided by Hermanas Engineering [Pty Ltd, ABN xx xxx xxx xxx] ("Hermanas"). The free trial lets your organisation use them on its own project files during the study and planning phase of a project.

2. Free, as is

The trial is provided free of charge and "as is". We aim for the tools to be available and correct, but we do not promise either. We may be unavailable for maintenance, we may fix things, and we may change how a tool works without notice. Nothing in the trial is a commitment to any level of service.

3. Results are an aid, not advice

The tools read your files and present what is in them. They do not replace the schedule of record (your P6 file), your planner, or your own checks. Approvals Horizon tags activities to statutory regimes by keyword; it is a planning aid and not legal or regulatory advice, and it may miss or mis-tag an approval. You are responsible for every decision you make with the results, and Hermanas is not liable for loss, delay or cost arising from reliance on them, to the fullest extent the law allows. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded.

4. Your files

5. Limits of the trial

6. Acceptable use

Do not try to extract the tools' code, rules or libraries, probe or load the service beyond normal use, upload anything unlawful or malicious, or share your sign-in with people outside your organisation. We may suspend a workspace that does.

7. Changes and ending the service

We may change these terms, change the tools, or end the free trial at any time. For anything material we will tell signed-in users on their next sign-in and give at least [14] days before a trial workspace is closed, so you can export your results. You can end your use at any time by asking us to delete your workspace.

8. Intellectual property

The tools, their design, rules, libraries and reports are Hermanas' intellectual property. The outputs built from your files are yours to use within your organisation and with your client. You may not resell, rebrand or offer the tools to others.

9. Licensed use

Use of the tools beyond the trial — on an execution-phase project, without limits or watermark, or with the full Hermanas platform — is under a separate written licence, which takes precedence over these terms where they differ.

10. Governing law

These terms are governed by the laws of Western Australia, and the courts there have jurisdiction. If part of these terms is unenforceable the rest still applies.
